Terms of Service

These Terms of Service ("Terms") govern your use of the Pensyve API, website, and managed memory service operated by Major7 Apps LLC ("we", "us", "our"). By using Pensyve, you agree to these Terms.

1. API Usage and Acceptable Use

You may use the Pensyve API to store, retrieve, and manage memory data for AI agents and applications. You agree not to:

  • Use the service to store illegal content or facilitate illegal activities
  • Attempt to reverse-engineer, decompile, or extract the source code of the managed service
  • Interfere with or disrupt the integrity or performance of the service
  • Access another user's data without authorization
  • Use the service for cryptocurrency mining or other resource-intensive operations unrelated to memory storage
  • Resell access to the API without a written agreement

2. Rate Limits

To ensure fair usage and service stability, the following rate limits apply:

  • Authentication endpoints — 20 requests per minute
  • API endpoints — 120 requests per minute
  • Global rate limit — 1,000 requests per 5 minutes

Exceeding these limits will result in HTTP 429 responses. Persistent abuse may result in temporary or permanent suspension of API access. Enterprise customers may negotiate custom rate limits.

3. Data Ownership

You retain full ownership of all memory content, metadata, and associated data you store through the Pensyve service. We do not claim any intellectual property rights over your data. We will not use your data to train machine learning models or share it with third parties except as required to operate the service (see our Privacy Policy).

4. Service Level Expectations

We strive to maintain high availability for the Pensyve managed service. However:

  • The free tier is provided on a best-effort basis with no uptime guarantees
  • The business tier targets 99.9% monthly uptime but does not include a formal SLA
  • Enterprise customers may negotiate SLA terms as part of their contract

Scheduled maintenance windows will be communicated in advance when possible.

5. API Key Responsibilities

You are responsible for keeping your API keys secure. Do not share API keys in public repositories, client-side code, or unsecured locations. If you believe an API key has been compromised, revoke it immediately from your dashboard. We are not responsible for unauthorized access resulting from compromised API keys.

6. Prohibited Uses

You may not use Pensyve to:

  • Store or distribute malware, viruses, or harmful code
  • Facilitate harassment, abuse, or threats against individuals
  • Store personal health information (PHI) without a BAA in place
  • Violate export control laws or sanctions
  • Circumvent rate limits or access controls through automated means

7. Limitation of Liability

To the maximum extent permitted by law, Pensyve and Major7 Apps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination and Data Export

You may terminate your account at any time from the dashboard settings. Upon termination:

  • You may export your data in JSON format before closing your account
  • We will retain your data for 30 days after termination to allow recovery, after which it will be permanently deleted
  • We reserve the right to terminate accounts that violate these Terms with or without notice

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use of the service after changes constitutes acceptance of the updated Terms.
